1. General

1.1 In these terms of use (collectively referred to as the "Terms of Use "), "Starbucks" or "we" or "us" means Coffee Concepts (Hong Kong) Limited, the authorized licensee of Starbucks Corporation in Hong Kong, and the "customer" or "you" means any person, firm, company or body which places an order with us.

1.2 By using the online order and pickup services (“Online Order & Pickup”) in this website provided by Starbucks for the territory of Hong Kong Special Administrative Region (“Hong Kong”), you agree that you have read these Terms of Use and that you accept and agree to be bound by them. Starbucks reserves the right to amend these Terms of Use anytime and will publish the revised version on the website.

1.3 The Online Order & Pickup is directed solely at persons accessing the website from Hong Kong.

 

2. Settings Requirements of Online Order & Pickup

In order to use this service, you are required to access Online Order & Pickup website through computers, mobile phones or tablets. Starbucks recommends the following browser settings for the best experience:

3. Eligibility

3.1 Online Order & Pickup is opened to all customers in Hong Kong. Before placing order through the Online Order & Pickup website (“Order”), please read the Terms of Use and Privacy Policy  . By using Online Order & Pickup, you are deemed to have agreed to be bound by the Terms of Use and Privacy Policy.

3.2 Customers are responsible for all actions, transactions and/or activities being conducted on this website.

3.3 Starbucks has the sole and absolute discretion to refuse or terminate the access right to or use of the Online Order & Pickup of or by any person for any reason whatsoever.

   

4. Online Ordering

4.1 This website only provides Online Order & Pickup with your self pick-up at designated Starbucks stores in Hong Kong. It does not provide any delivery service.

4.2 Customers can place Orders with pickup time of the same day of the transaction is made. Customers are required to finish the Ordering procedures prior to the expected pickup time. 

4.3 To place an Order, the customer needs to provide an email address for receiving the order confirmation email and/or his/her phone number for contact purpose. If the customer is providing contact of another person, he/she is required to obtain the consent of such other persons, concurrently, the customer is also obligated to be responsible for providing such personal information.

4.4 After receiving your Order, Starbucks will acknowledge receipt of your Order by email or other communication channels. However, it is not an acceptance of your Order. Starbucks reserves the right to reject any Order without giving any reasons. In the event that Starbucks is unable to accept your Order (for example due to payment issue), Starbucks will notify you by phone or email.

4.5 Separate Orders and payment are required if Orders are to be collected at different time or at different stores.

4.6 You acknowledge and agree that in order to process and follow up your Orders and payments and for other directly related purposes, Starbucks will use, collect and process your personal data submitted by you. The personal data includes, without limitation, your name, phone number, email address, products, price and date of the purchase etc. If you place an Order for other people, Starbucks will use, collect and process the information of the recipient designated by you, including but not limited to his/her name, email address and phone number. Please read the Privacy Policy carefully to understand how Starbucks collects, uses and discloses information about its customers.

5. Product information and pricing

5.1 Starbucks reserves the right to update the price and/or product details at any time. All the product details and/or price are based on the information displayed at the Online Order & Pickup when Starbucks confirms the Order.

5.2 Starbucks shall use its reasonable effort to ensure products displayed on the website are in stock. If any product is out of stock, Starbucks reserves the right to offer alternative product(s) of similar pricing and category as replacement.

5.3 The prices posted on this website are applicable to Online Order & Pickup only. Some products may be priced differently at Starbucks store(s). Prices are subject to change without prior notice.

5.4 Starbucks may at its sole and absolute discretion decline any Order, set credit limit(s) against any person, transaction or credit card and/or restrict purchase quota(s) at any time.

5.5 Product information, colour, pricing and image(s) in the website are for reference only.

6. Payment

6.1 Payment for Order must be settled by a valid Visa card, MasterCard, Apple Pay, Google Pay and any other available payment methods via the Online Order & Pickup.

6.2 All prices are listed in Hong Kong Dollars. In no event that Starbucks shall be responsible for any cost charged or incurred by the customer due to any bank, payment method and/or currency.

6.3 The system of Online Order & Pickup has applied Secure Socket Layer (SSL) technology. All personal information including customer’s credit card number, name, email address and phone number will undergo encryption before transmission through internet to protect the information from being accessed by unauthorized third-party during transmission.

6.4 Starbucks reserves the right to modify payment terms for any Order without prior notice.

6.5 Gift certificate, cash voucher or discount voucher are not redeemable for Online Order & Pickup.

6.6 Any transaction at the Online Order & Pickup will not be recorded in Starbucks RewardsTM Stars Collection.

6.7 Unless otherwise as specified by Starbucks, you may not use any Starbucks RewardsTM member benefits and rewards, physical coupons, gift certificates, Starbucks Card eGift, Starbucks Drink eGift, etc. to redeem product(s) or deduct product price in the use of Online Order & Pickup .

7. Order Pickup

7.1 Under general circumstances, the Order should be picked up during the business hours of the selected stores, which may change due to operational status of the particular store(s). When the selected store becomes unavailable for pickup at certain dates and time slots, Starbucks will contact the customer to arrange alternative pickup time and/or stores.

7.2 Upon completion of the Order, any change of Order will not be entertained.

7.3 Starbucks shall use its reasonable effort to ensure preparation of the Orders to be completed as soon as commercially practicable after Order completion, but pickup time in particular store(s) may be reasonably delayed due to operational circumstances.

7.4 If an Order is not being picked up within 30 minutes from the selected pickup time specified on the Order, the Order will be deemed cancelled / void and no refund will be made. Notwithstanding the foregoing, the 30-minute limit will be reduced if such time has passed the business hours of the relevant store(s).

7.5 During pickup, customers must show the valid Order number or Order confirmation email to the staff for verification. Each Order number can be used for pickup once only. Pickup records kept by Starbucks shall be deemed conclusive.

7.6 Customers should keep properly the Order confirmation email and Order number. Anyone showing the staff of the relevant store with a valid Order number or confirmation email will be deemed as an authorized representative for Order pickup.

8. Refund and Cancellation

8.1 Upon confirmation of the Order, the Order cannot be cancelled or the item(s) cannot be altered by the customer.

8.2 All items sold are non-refundable, non-returnable and non-exchangeable after payment of such Order has been completed.

 

9. Copyright and Trademark

9.1 Unless otherwise noted, all materials on our website are protected as the copyrights, trade dress, trademarks and/or other intellectual properties owned by Starbucks and/or its subsidiaries and affiliates or by other parties that have licensed their material to Starbucks. All rights not expressly granted are reserved.

9.2 Your use of the materials included on our website is for informational purposes only. You agree you will not distribute, publish, transmit, modify, display or create derivative works from or exploit the contents of this site in any way. You agree to indemnify, defend and hold harmless Starbucks for any and all unauthorized uses you may make of any material on this website. You acknowledge the unauthorized use of the contents could cause irreparable harm to Starbucks and that in the event of an unauthorized use, we shall be entitled to an injunction in addition to any other remedies available at law or in equity.

If you are between the ages of 13 and 18, you may only use our Online Order & Pickup under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use. If your parent or legal guardian does not agree to these Terms of Use, you must discontinue its use.

11. Indemnification

At Starbucks’s request, you agreed to defend, indemnify, and hold harmless Starbucks and their affiliated companies, independent contractors, service providers and consultants and their respective employees, contractors, agents, officers, directors, representatives, and/or advisers fully from and against any and all claims, suits, losses, damages, costs, lawsuits, fines, penalties, liabilities, and/or expenses (direct and/or indirect, and including legal fees and expenses on a full indemnity basis) that arise from or relate to the your use or misuse of Online Order & Pickup, violation of these Terms of Use or violation of any rights of a third party. Starbucks reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate in asserting any available defenses.

12. Warranties; Disclaimers

STARBUCKS IS PROVIDING THE Online Order & Pickup TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS, AND YOU ARE USING THE Online Order & Pickup AT YOUR OWN RISK. Starbucks reserves the right to stop the operation of the Online Order & Pickup at any time and for any reason.

13. No Liability

13.1 TO THE FULLEST EXTENT ALLOWABLE UNDER APPLICABLE LAW, IN NO EVENT SHALL STARBUCKS OR THEIR AFFILIATED COMPANIES (A) BE LIABLE TO YOU WITH RESPECT TO USE OF THE Online Order & Pickup; AND (B) BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, LOST PROFITS, LOSS, THEFT OR CORRUPTION OF YOUR INFORMATION, THE INABILITY TO USE THE Online Order & Pickup OR ANY OF ITS FEATURES OR DEVICE FAILURE OR MALFUNCTION. YOUR SOLE REMEDY IS TO CEASE USE OF Online Order & Pickup. NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THESE TERMS OF USE, NOTHING IN THESE TERMS OF USE SHALL EXCLUDE OR RESTRICT STARBUCKS AND THEIR AFFILIATED COMPANIES’ LIABILITY FOR DEATH OR PERSONAL INJURY RESULTING FROM THEIR NEGLIGENCE.

13.2 In no event shall Starbucks be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature or causes beyond our reasonable control including, without limitation, internet failures, computer equipment failures, telecommunication equipment failures, electrical power failures, strikes, labour disputes, riot, protest, shortages of labour or materials, fires, floods, storms, explosions, acts of God or delays or non-performance by third parties.

 

14. Amendments to These Terms of Use

14.1 Starbucks encourages you to regularly check these Terms of Use, learn about the latest version, and consider whether or not to continue to use the Online Order & Pickup.

Starbucks has the right to revise these Terms of Use from time to time. In such case, Starbucks will notify you in advance of the amended Terms of Use and the effective date hereof, and also publish the amended Terms of Use. If you continue to use the Online Order & Pickup on or after the effective date of any such amendment, it will be deemed that you accept these Terms of Use as amended.

15. Governing Law and Dispute Resolution

These Terms of Use are governed by the laws of Hong Kong, without regard to conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods shall have no applicability. You irrevocably consent to the exclusive jurisdiction of the courts of Hong Kong for purposes of any legal action arising out of or related to the use of the Online Order & Pickup or these Terms of Use.

In the case of discrepancies between the English and Chinese versions, the English version shall prevail.

15. Governing Law and Dispute Resolution

These Terms of Use are governed by the laws of Macau, without regard to conflict of laws rules. 1.2 By using the online order and pickup services (“Online Order & Pickup”) in this website provided by Starbucks for the territory of Hong Kong Special Administrative Region (“Hong Kong”), you agree that you have read these Terms of Use, Personal Data Collection Statement (“PICS”) and Privacy Policy (PICS and Privacy Policy are collectively referred to as “Privacy Policy”) and that you accept and agree to be bound by them. 3.1 Online Order & Pickup is opened to all customers in Hong Kong. Before placing order through the Online Order & Pickup website (“Order”), please read the Terms of Use and Privacy Policy. By using Online Order & Pickup, you are deemed to have agreed to be bound by the Terms of Use and Privacy Policy.

3.2 Customers are responsible for all actions, transactions and/or activities being conducted on this website.

3.3 Starbucks has the sole and absolute discretion to refuse or terminate the access right to or use of the Online Order & Pickup of or by any person for any reason whatsoever.

   

4. Online Ordering

4.1 This website only provides Online Order & Pickup with your self pick-up at designated Starbucks stores in Hong Kong. It does not provide any delivery service.

4.2 Customers can place Orders with pickup time of the same day of the transaction is made. Customers are required to finish the Ordering procedures prior to the expected pickup time. 

4.3 To place an Order, the customer needs to provide an email address for receiving the order confirmation email and/or his/her mobile number for contact purpose. If the customer is providing contact of another person, he/she is required to obtain the consent of such other persons, concurrently, the customer is also obligated to be responsible for providing such personal information.

4.4 After receiving your Order, Starbucks will acknowledge receipt of your Order by email and/or other communication channels. However, it is not an acceptance of your Order. Starbucks reserves the right to reject any Order without giving any reasons. In the event that Starbucks is unable to accept your Order (for example due to payment issue), Starbucks will notify you by phone or email.

4.5 Separate Orders and payment are required if Orders are to be collected at different time or at different stores.

4.6 You acknowledge and agree that in order to process and follow up your Orders and payments and for other directly related purposes, Starbucks will use, collect and process your personal data submitted by you. The personal data includes, without limitation, your name, phone number, email address, products, price and date of the purchase etc. If you place an Order for other people, Starbucks will use, collect and process the information of the recipient designated by you, including but not limited to his/her name, email address and phone number. Please read the Privacy Policy carefully to understand how Starbucks collects, uses and discloses information about its customers.

5. Product information and pricing

5.1 Starbucks reserves the right to update the price and/or product details at any time. All the product details and/or price are based on the information displayed at the Online Order & Pickup when Starbucks confirms the Order.

5.2 Starbucks shall use its reasonable effort to ensure products displayed on the website are in stock. If any product is out of stock, Starbucks reserves the right to offer alternative product(s) of similar pricing and category as replacement.

5.3 The prices posted on this website are applicable to Online Order & Pickup only. Some products may be priced differently at Starbucks store(s). Prices are subject to change without prior notice.

5.4 Starbucks may at its sole and absolute discretion decline any Order, set credit limit(s) against any person, transaction or credit card and/or restrict purchase quota(s) at any time. Starbucks also reserves the absolute right to add, remove, and/or adjust from time to time any minimum Order charges, additional service fees and/or charges applicable to Online Order & Pickup without prior notice, but Starbucks will specify and notify you such fees and/or charges, if any, during the Ordering processes.

5.5 Product information, colour, pricing and image(s) in the website are for reference only.

6. Payment

6.1 Payment for Order must be settled by a valid Visa card, MasterCard, Apple Pay, Google Pay and any other available payment methods via the Online Order & Pickup.

6.2 All prices are listed in Hong Kong Dollars (HKD). In no event that Starbucks shall be responsible for any cost charged or incurred by the customer due to any bank, payment method and/or currency.

6.3 The system of Online Order & Pickup has applied Secure Socket Layer (SSL) technology. All personal information including customer’s credit card number, name, email address and phone number will undergo encryption before transmission through internet to protect the information from being accessed by unauthorized third-party during transmission.

6.4 Starbucks reserves the right to modify payment terms for any Order without prior notice.

6.5 Gift certificate, cash voucher or discount voucher are not redeemable for Online Order & Pickup.

6.6 Any transaction at the Online Order & Pickup will not be recorded in Starbucks® Rewards Stars Collection.

6.7 Unless otherwise as specified by Starbucks, you may not use any Starbucks® Rewards member benefits and rewards, physical coupons, gift certificates, Starbucks Card eGift, Starbucks Drink eGift, etc. to redeem product(s) or deduct product price in the use of Online Order & Pickup .

7. Order Pickup

7.1 Under general circumstances, the Order should be picked up during the business hours of the selected stores, which may change due to operational status of the particular store(s). When the selected store becomes unavailable for pickup at certain dates and time slots, Starbucks will contact the customer to arrange alternative pickup time and/or stores.

7.2 Upon completion of the Order, any change of Order will not be entertained.

7.3 Starbucks shall use its reasonable effort to ensure preparation of the Orders to be completed as soon as commercially practicable after Order completion, but pickup time in particular store(s) may be reasonably delayed due to operational circumstances.

7.4 If an Order is not being picked up within 30 minutes from the selected pickup time specified on the Order, the Order will be deemed cancelled / void and no refund will be made. Notwithstanding the foregoing, the 30-minute limit will be reduced if such time has passed the business hours of the relevant store(s).

7.5 During pickup, customers must show the valid Order number or Order confirmation email to the staff for verification. Each Order number can be used for pickup once only. Pickup records kept by Starbucks shall be deemed conclusive.

7.6 Customers should keep properly the Order confirmation email and Order number. Anyone showing the staff of the relevant store with a valid Order number or confirmation email will be deemed as an authorized representative for Order pickup.

8. Refund and Cancellation

8.1 Upon confirmation of the Order, the Order cannot be cancelled or the item(s) cannot be altered by the customer.

8.2 All items sold are non-refundable, non-returnable and non-exchangeable after payment of such Order has been completed.

 

9. Copyright and Trademark

9.1 Unless otherwise noted, all materials on our website are protected as the copyrights, trade dress, trademarks and/or other intellectual properties owned by Starbucks and/or its subsidiaries and affiliates and/or by other third parties that have licensed their material to Starbucks. At Starbucks’s request, you agreed to defend, indemnify, and hold harmless Starbucks and their affiliated companies, independent contractors, service providers and consultants and their respective employees, contractors, agents, officers, directors, representatives, and/or advisers fully from and against any and all claims, suits, losses, damages, costs, lawsuits, fines, penalties, liabilities, and/or expenses (direct and/or indirect, and including legal fees and expenses on a full indemnity basis) that arise from or relate to the your use or misuse of Online Order & Pickup, violation of the Terms of Use or violation of any rights of a third party. 10. Minors

You acknowledge that you are at least 18 years old and are fully able to understand, agree to and abide by the Terms of Use . If you are between the ages of 13 and 18, you may only use our Online Order & Pickup under the supervision of a parent or legal guardian who agrees to be bound by the Terms of Use. If your parent or legal guardian does not agree to the Terms of Use, you must discontinue its use.

11. Indemnification

At Starbucks’s request, you agreed to defend, indemnify, and hold harmless Starbucks and their affiliated companies, independent contractors, service providers and consultants and their respective employees, contractors, agents, officers, directors, representatives, and/or advisers fully from and against any and all claims, suits, losses, damages, costs, lawsuits, fines, penalties, liabilities, and/or expenses (direct and/or indirect, and including legal fees and expenses on a full indemnity basis) that arise from or relate to the your use or misuse of Online Order & Pickup, violation of the Terms of Use or violation of any rights of a third party. Starbucks reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate in asserting any available defenses.

12. Warranties; Disclaimers

STARBUCKS IS PROVIDING THE ONLINE ORDER & PICKUP TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS, AND YOU ARE USING THE ONLINE ORDER & PICKUP AT YOUR OWN RISK. TO THE FULLEST EXTENT ALLOWABLE UNDER APPLICABLE LAW, STARBUCKS DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS OR IMPLIED BY STATUTE, COMMON LAW, TRADE USAGE, OR OTHERWISE, INCLUDING ANY WARRANTIES THAT THE PRODUCTS ARE MERCHANTABLE, RELIABLE, AVAILABLE, ACCURATE, FIT FOR A PARTICULAR PURPOSE OR NEED OR SATISFACTORY QUALITY, NON-INFRINGING OR FREE OF DEFECTS OR VIRUSES OR ABLE TO OPERATE ON AN UNINTERRUPTED BASIS, OR THAT THE USE OF THE ONLINE ORDER & PICKUP BY YOU ARE IN COMPLIANCE WITH LAWS APPLICABLE TO YOU THAT YOUR INFORMATION TRANSMITTED IN CONNECTION WITH THEONLINE ORDER & PICKUP WILL BE SUCCESSFULLY, ACCURATELY OR SECURELY TRANSMITTED OR RECEIVED, THAT ORDER WILL BE AS PLACED OR READY AT THE SUGGESTED TIME, OR THAT ANY PARTICULAR ITEM ORDERED WILL BE AVAILABLE.

Starbucks reserves the right to stop the operation of the Online Order & Pickup at any time and for any reason.

13. No Liability

13.1 TO THE FULLEST EXTENT ALLOWABLE UNDER APPLICABLE LAW, IN NO EVENT SHALL STARBUCKS OR THEIR AFFILIATED COMPANIES (A) BE LIABLE TO YOU WITH RESPECT TO USE OF THE ONLINE ORDER & PICKUP; AND (B) BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, LOST PROFITS, LOSS, THEFT OR CORRUPTION OF YOUR INFORMATION, THE INABILITY TO USE THE ONLINE ORDER & PICKUP OR ANY OF ITS FEATURES OR DEVICE FAILURE OR MALFUNCTION. YOUR SOLE REMEDY IS TO CEASE USE OF ONLINE ORDER & PICKUP. TO THE FULLEST EXTENT ALLOWABLE UNDER APPLICABLE LAW, IN NO EVENT (BUT SUBJECT TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW) SHALL THE AGGREGATE LIABILITY OF STARBUCKS OR, THEIR AFFILIATED COMPANIES, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHER THEORY, ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE Online Order & Pickup , EXCEED ANY COMPENSATION YOU PAY, IF ANY, TO STARBUCKS FOR ACCESS TO OR USE OF THE ONLINE ORDER & PICKUP, for a particular order GIVING RISE TO SUCH LIABILITY. NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THE TERMS OF USE, NOTHING IN THE TERMS OF USE SHALL EXCLUDE OR RESTRICT STARBUCKS AND THEIR AFFILIATED COMPANIES’ LIABILITY FOR DEATH OR PERSONAL INJURY RESULTING FROM THEIR NEGLIGENCE.

13.2 In no event shall Starbucks be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature or causes beyond our reasonable control including, without limitation, internet failures, computer equipment failures, telecommunication equipment failures, electrical power failures, strikes, labour disputes, riot, pandemic, protest, shortages of labour or materials, fires, floods, storms, explosions, acts of God or delays or non-performance by third parties.

   

14. Amendments to The Terms of Use

Starbucks encourages you to regularly check the Terms of Use, learn about the latest version, and consider whether or not to continue to use the Online Order & Pickup.

Starbucks has the right to revise the Terms of Use from time to time. In such case, Starbucks will notify you in advance of the amended Terms of Use and the effective date hereof, and also publish the amended Terms of Use in the website. If you continue to use the Online Order & Pickup on or after the effective date of any such amendment, it will be deemed that you accept the Terms of Use as amended.

 

15. Governing Law and Dispute Resolution

The Terms of Use are governed by the laws of Macau, without regard to conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods shall have no applicability. You irrevocably consent to the exclusive jurisdiction of the courts of Macau for purposes of any legal action arising out of or related to the use of the Online Order & Pickup or the Terms of Use.

In the case of discrepancies between the English and Chinese versions, the English version shall prevail.
